Are you sure?
When I bought my 2008 (Nov. 2007) the heavy duty winter mats were not available (there was a recall). When it finally became available, I got a very nice, heavy duty mat that is designed very thin (only a few inches wide and the area aligned with the brake pedal) at the top, leaving little possibility of it covering gas pedal.
There are three mats (that I am aware of):

• Carpeted mats
• Winter heavy duty (after 2008)
• Winter thin overlay clear plastic

I believe the problem with the overlay was due to stacking issues, etc. The redesigned heavy duty can't be stacked with the available clip.
I imagine the overlay will be replaced, but I believe the second one is okay and the third one is under recall...but I could be wrong.

 

Yes I am sure what the dealer told me.
#2's are being replaced with #3's and customers were getting livid about it.
So now they suggest hiding the #2's when coming in for the pedal modification.
The 2009 mat recall was just as you described they replaced #2's with modified #2's.
