Default parking pawl doesn't seem to work

I just finished freshening the the HCH-1 transmission, and the parking pawl isn't stopping the differential from rotating. it was engaging and disengaging when the case cover was off and tested with the lever. i did have the transmission (intentionally) flipped over with the left side face up later. is it possible the spring could drop out of the pawl if the transmission was flipped over?

so, i pulled the CVT out again. (so much faster the 2nd time) about 90 minutes to putting trans on the workbench. time was saved since it was still on the lift.

i pulled the cover, and the spring was high and not pushing the pawl in. which means there is room for it to rise. I pushed it down a bit and pawl was working correctly. there is no spacer in the diagrams, nor when i first removed it.

may be time to get the welder and add a tang to the end of the one end.

crash course: the single axle drive on the honda? well, that applies to the parking pawl too.
both sides have to turn together. and..click.
