So nobody mentioned that the battery cover needed to be installed for it to work....
Put the new to me battery in. Same symptoms, bolted the cover on and it started. I have two dead cylinders but it is running, now on to engine diagnostics.

The big silver top part. I'd had the black cable cover on, but not bolted down, maybe it was that detail, but either way we put the silver cover back on and put most of the bolts back in and it started.

Thank you to everyone who took the time to reply to this thread. My 08 is now running, I got to source a reconditioned hybrid battery from the US. Now its running as it should. Hoping for many more years to come again.
