I am satisfied with GM and my dealer for giving me a new Yukon Hybrid!
That's a real surprise coming from someone who drives a foreign car. It's no wonder the US economy is going down the tubes. No one sticks up for US products or workers anymore.

Well, the initial purchaser of the hybrid gets the credit, and you will be the initial purchaser of two hybrids, so I don't see why you wouldn't.

The last word, then I'm closing this can of worms for good:
Picture this, you make a product call "widgetX", you put your $$, effort and pride into that product, and send it off to the retailers to sell. One of the realtors drops your widgetX, breaks it and then sells it to some poor, unsuspecting customer as if it was new.
You go to a widget forum - that forum has people discussing all different widgets: widegetA, WidgetB, WidgetC, etc....
You see a thread called "New WidgetX, I am cosidering lawsuit against retailer"
Do you see anything wrong with that thread title title from WidgetX's perspective?
I have no interest at all in GM (except of course a personal interest to see any Canadian/US company do well and not be treated unfairly).

You know, the damage other than the little dent was repaired and there is nothing left to repair. You had to have the body shop use their high intensity illumination to even see where it was before. I don't think you have a case against them for the repair. It is strickly a misrepresentation case. I don't think anyone wins in court. But I suspect without a claim against them, they will not make you whole.
I do think you have been just slightly misrepresentative in the use of this forum to make your case. Believe me, they won't care that you put this on here. GM might, but the dealer won't. Just my opinion and would like to see it end well for all concerned. What if the dealer took this vehicle in trade? What if someone in a parking lot hit your truck? A bunch of variables here that you are directing at the dealer when it might have been some other place that the damage occurred. Again, just my thoughts here. Good luck.

On that same note, you really shouldn't waste the District Attorney's time on this minor issue. I would hope you would leave the already strained US public purse to focus on rapes, murderers, child abuse, etc. I can guarantee you that the DA will do nothing.
Its true about the DAs office, and I hate to waste taxpayers hard earn money on a frivolous case, I am still trying to collect a hot check for $4200 that the DA has attempted collecting for more than 4 months now.
On the other hand, I still feel cheated, I will try to work something out with the dealer and hopefully end up with a win-win situation.
I am convinced that they knew that the damage was there, turns out they had a hail storm hit their lot on July 1st, 2009, they repaired a bunch of cars, on this truck it appears like they repaired just a few dents and left the minor ones. If the case made it to court (which most likely wont), and the lawyer proves intentionallity or previous knowledge from the dealer then I think the judge will have no option but to award damages.
I have a key witness that actually assisted on the repair of several vehicles last summer at the dealers lot. Turned out to be the same repair facility where I took the Hybrid.

I re-read my comments and felt that I was not sypathetic to your situation and feel that I owe you that. So I am! If it were me and my vehicle, I would feel the same way. I don't know what the law says about minor cosmetic damage to a vehicle and if a dealer or manufacturer can make repairs to them prior to sale and still call them new. If they can, I too think it is misrepresentation but it may be legal, I don't know. Good luck again.
The issue is whether the dealer or the company has to disclose damage prior to delivery. I think we have determined that anything over $500 in repair would have to be reported. Damage under $500 can go undiscolsed as long as it was repaired.
So the test comes down to 1. was it repaired? and
2. did the repairs cost the dealer/company under $500?
If the dealership can demonstrate that the repairs at their cost was less than $500, then a judge/arbitrator would likely tell them to make sure it was fixed correctly - end of story.
If it has not been repiared satisfactorily, the legal case might be slightly different, but the result could be the same - fix it correctly - end of story.
