If the insurance company writes a check for a new car I think they own the old one and can sell it for scrap.
This is taken into account to calculate the premiums.
If the owner takes the battery I think it would be stealing.

UPDATE: We *finally* heard yesterday, on the 8th day after the wreck, that they would be totalling the car -- hallelujah! I have NO faith that any repairs would have made my nearly-new car "right" after such a collision. So now, we wait for the actual settlement...at least there is NO dispute about the cause of the crash -- but I'm sure the insurance companies will be slugging it out about settlements. I can tell you all that I will NOT settle for less than a replacement vehicle -- that means a 2007, new, HCHII with navi.

Will keep the group posted on the outcome -- but hope none of you has to go through this. I *loved* my HCHII!!
